Two-tier justice, a.k.a Private prosecution is begining to feature prominently in developed countries. Will it be a trend that could trickle down to emerging economies? A private prosecution is a criminalproceeding initiated by an individual or private organisation (such as a prosecution association) instead of by a public prosecutorwho represents the state. Private prosecutions are allowed under common law, but have become rare in modern times as most prosecutions are now handled by professional public prosecutors instead of private individuals who retain (or are themselves) barristers.
The sudden interest by citizen to use private-prosecutors is indicative of a growing decline in trust of the police. Recent saga in the US are already some of the signs and with this trend becoming somewhat accepted, the lack of regulations could spark potential shake in the judiciary system.
